Many old people fear signing a power of attourney because the attorney is the one who triggers that. If the old person thinks they're fine the attorney can sort of challenge them for custody of themselves.
When the atourney is also a beneficiary of the old persons will this creates a very bad situation.

But then if old people don't sign a power of attorney, the problem is that when they actually need one its too late. If you were in a car accident and in a comma you couldn't sign it, and if you had dementia the signing would likely be challenged.

That's why everyone hates the state trustee, their job is to seize estates and sue unfit carers. It's such a godawful job that cenno tier people take it.

Often old people would be better giving power of attorney to a lawyer, so relatives can do what they normally would without the legal power to do anything retarded.
