Chad Mizelle @ChadMizelle47 - DOJ has sued the district court in Maryland to stop their unlawful practice of issuing “automatic injunctions” for illegal aliens detained in MD who file a habeas petition.
This Department of Justice will continue to vigorously defend @POTUS’s ability to implement his agenda without interference from activist federal judges.
These injunctions automatically issue:
▪️No matter whether the illegal alien even seeks emergency relief.
▪️No matter whether the court even has jurisdiction over the illegal alien’s claims.
▪️No matter how frivolous the illegal alien’s claims may be.
▪️No matter whether the usual standards for injunctive relief are met.
Unbelievably, an injunction automatically issues even if an immigration attorney files a habeas petition in Maryland incorrectly stating that the illegal alien is detained in Maryland, when the illegal alien is actually detained in Texas. (This literally happened.)
Automatic injunctions flagrantly violate Supreme Court precedent. In the Court’s words, an injunction is never “a matter of right.” But the Maryland federal district court offers immediate injunctions, as “a matter of right,” to any illegal alien who files in its court.
This obviously illegal practice cannot stand. To stop it, the Department of Justice has no choice but to sue the Maryland federal district court—and its judges—to ensure that they stop overstepping their authority in this critical area.
