Enforcement Authority: Our sergeants-at-arms and DPS have the legal authority to locate and retrieve absent members within Texas borders. This is not theoretical-it was used in 2003 and again in 2021.
Penalties for Absence: Members absent without leave can face:
- Fines of $500 per day
Responsibility for retrieval costs
- Operating budget reductions
Reprimand, censure, or even expulsion
Escalation Option: Should members flee the state for an extended period, the Governor has the constitutional authority to declare their seats vacant under the Texas Election Code. This would lower the quorum threshold and allow the House to act.
The question is… Are Republicans willing to STAND UP AND FIGHT? I know I am!
