John Eastman @DrJohnEastman - Big news yesterday in the Arizona criminal case against the 2020 electors and several attorneys, myself included. Back in May, the trial court held that the Attorney General had failed to make a fair presentation to the Grand Jury, and ordered a remand to a new Grand Jury. The Attorney General appealed that order, and yesterday the Arizona Court of Appeals denied her appeal. Important step in the right direction. The Attorney General now has to begin a new grand jury proceeding within 15 days, or present the case to a judge for a probable cause hearing. She can also appeal the loss to the Arizona Supreme Court to prolong this embarrassment of a prosecution longer, but these hyper-partisan prosecutors (like Fani Willis in Georgia) need to realize the American people have had it with this lawfare. As the Democrat-appointed judge held last week when dismissing the criminal case against the electors in Michigan, it was not a crime for electors to cast contingent ballots to prserve the still-pending legal challenges; it was instead an exercise of the constitutionally-protected right to petition the government for redress of grievances. The Attorney General needs to get the message and drop this "no crime here" indictment. The Arizona Court's order denying the appeal is attached.
