But my rejoinder is that a “norm” that dates back only to Watergate is not longstanding, let alone binding. The Republic is much older than 1975 or so. And norms are not the Constitution or laws or court rules. Also, whether the Watergate norm is “good government” or not is highly contestable. We structural constitutional conservatives believe it’s terrible government that defeats accountability to the citizenry. Career lawyers at Main Justice and the U.S. Attorneys’ Offices can’t be directly unelected. I think you and Avlon see that as virtue, but we see it as vice.
Also, even in the post-Watergate era, Presidents of both parties have directed that particular prosecutions occur. See @MarkPaoletta’s threads over recent days giving the examples.
But I will join you in commending this as a decent, civil conversation, which I appreciate.

I hear you. Indeed DOJ is of course part of the Executive Branch. I’ve said elsewhere (maybe even here, not sure) that there’s no specific constitutional or statutory imperative that DOJ be independent from White House, etc. I do argue that it’s long been understood by both parties that it’s in the best interested of good government to have an independent prosecutorial function. It’s more of a norm / tradition / good government practice (which I believe in). But yes there’s no constitutional mandate. Good discussion.
