U.S. Tech Workers @USTechWorkers - Following reports that U.S. companies were replacing American employees with foreign workers under the H-1B program created by the 1990 Immigration Act, Congress took steps in 1998 that ultimately exacerbated the problem.
The American Competitiveness and Workforce Improvement Act (ACWIA) of 1998 increased the H-1B visa cap while nominally introducing safeguards to prevent the replacement of U.S. workers. However, the statute included broad exemptions: employers were permitted to displace U.S. workers if the H-1B employee earned at least $60,000 annually or possessed a master’s degree. These provisions effectively nullified the intended protections.
