https://x.com/SenKatieBritt/status/1990104429295521918Shipwreckedcrew @shipwreckedcrew - Rao's decision on the panel was that Boasberg abused his discretion by giving DOJ the opportunity to "purge" the contempt by bringing the aliens back into the country. She said that invaded the exclusive authority of the Executive, and that the TRO that would have "enforced" was already determined by SCOTUS to be beyond his jurisdiction.
BUT, she joined with Pillard to find that Boasberg was entitled to continue with considering potential criminal contempt based on the March 14 defiance of his Order.
Rao and Katsas vacated his Probable Cause finding, but Rao and Pillard remanded it back to Boasberg for further proceedings consistent with Rao's opinion.
Denail of en banc was premised on this finding -- that Boasberg could continue with the contempt inquiry, he just had to start over and not include a "purge" option that was beyond his authority.
I said in August that Rao's opinion was trouble - for this exact reason.
