Melissa Hallman @dotconnectinga - BREAKING: A federal judge dismissed criminal indictments against former FBI Director James Comey and New York Attorney General Letitia James, ruling that the prosecutor who brought the cases, Lindsey Halligan, was not lawfully appointed as interim U.S. Attorney for the Eastern District of Virginia.
U.S. District Judge Cameron Currie found Halligan’s appointment invalid, meaning she lacked authority to present evidence to grand juries or sign indictments.
Currie issued separate rulings for each case and expressed skepticism toward the Justice Department’s characterization of the issue as a “paperwork error” during a November 13 hearing.
The decision could affect other prosecutions handled by Halligan’s office. A similar ruling invalidated Alina Habba’s appointment as New Jersey U.S. Attorney, leaving cases there in limbo pending appeal.
