Melissa Hallman @dotconnectinga - ICYMI: The RNC filed a lawsuit Tuesday against Michigan Secretary of State Jocelyn Benson, alleging that state election laws violate the Michigan Constitution by permitting non-residents—such as spouses of military and overseas voters, or children born to state residents—to cast ballots.
The suit challenges overseas absentee voting provisions, arguing they contravene the constitution’s six-month residency requirement for voters, which lawmakers can modify or waive for former residents but not non-residents.
RNC Chairman Joe Gruters stated: “Individuals who have never lived in the United States, let alone Michigan, should not have a say in Michigan’s elections.” He added: “Democrat Secretary of State Jocelyn Benson is ignoring the Michigan Constitution by allowing people who don’t live in Michigan to vote in Michigan. That’s why the RNC is fighting to ensure only lawful votes count.”
The constitution specifies: “Every citizen of the United States who has attained the age of 21 years, who has resided in this state six months, and who meets the requirements of local residence provided by law, shall be an elector and qualified to vote in any election except as otherwise provided in this constitution. The legislature shall define residence for voting purposes.”
