3. A Immigration case I'll probably write an article about. Goes back to Trump 1 "Remain in Mexico Policy" that required asylum seekers to wait on the Mexico side of the border while their Asylum claims were processed. This included a "metering policy" where Immigration Officials made a decision about how many people seeking to cross into the US at the border would be allowed though the port of entry on a daily basis. All persons in excess of that number were kept in Mexico. An immigration group sued and won, arguing that merely reaching the port of entry was enough to require immigration officials to accept their asylum claims. Ninth Circuit affirmed. But Biden Admin. changed the policy in 2021 and -- as we all known now -- allowed all asylum seekers to simply flow across the border without restriction. Asylum applications were processed and the aliens were given court date years in the future.
Case remained alive throughout the Biden Admin, and put back on Court's calendar this year. The issue is what does "arriving in" the U.S. mean -- actually entering the U.S. or just arriving at the border crossing location.
Court holds that an alien standing in Mexico does not “arriv[e] in the United States” by attempting, and failing, to set foot in this country. An alien “arrives in the United States” only when he crosses the border. The INA thus neither entitles an alien standing in Mexico to apply for asylum nor requires an immigration officer to inspect him.
