Duffy's emergency interim rule that would have prevented the state of Massachusetts (and other states) from issuing non-domiciled CDLs to a broad category of noncitizens. Judges Flo Pan (Biden) and Robert Wilkins (Obama) claimed the DOT "does not appear to have demonstrated any safety benefit from the rule [and] the county petitioner has furnished evidence that the rule would harm public safety by forcing it to replace safer experienced drivers with less-safe new drivers." The illegal immigrant who killed a PA state trooper last week received his non-domiciled CDL in Feb 2026.
