Instead, much of the current fight is over hearsay rules, legal inferences, aggravators, and whether the case qualifies for the death penalty.
The State argues Robinson knowingly endangered others by firing from 410 feet at Kirk while people stood directly in his line of fire — and that he knew he could miss, citing the practice targets still in his apartment showing he seldom hit the bullseye.
But the biggest takeaway is how little of the core case identifying Robinson as Charlie Kirk’s killer is actually being challenged at this stage.
Candace has spent eleven months insisting based on no evidence that Robinson was never on campus, his rifle wasn’t the murder weapon, and his text-message confessions were fabricated.
His own lawyers aren’t arguing any of that.
They’re asking the court to strike counts and the aggravating circumstance supporting the capital murder charge.
They’re not arguing that the man on the roof wasn’t Tyler Robinson.
