The East Wing federal court injunction against construction goes into effect Friday if the Chief Justice or the Court as a whole does not move first. One or the other should.
I discussed with two more law professors Monday why I hope the Chief Justice gets to the national security issue though I suspect with them that common sense on "standing" will win the case. The Chief Justice and I worked in President Reagan's White House Counsel's office, and as I got briefed on security in the East Wing bunker, I suspect he and in a later year Justice Kavanaugh had the same experience. I have to think they will bring their colleagues up to speed on the practical realities of security around and within the White House and related grounds (as if anyone needed it anymore). Hope it is answered quickly. It's an urgent national security issue and I expect the Court to see it that way even if they give President Trump the win on technical grounds.
