Insurrection Barbie @DefiyantlyFree - The Department of Justice just announced a major shift in how it intends to enforce the Foreign Agents Registration Act.
DOJ has not changed the text of FARA. But it has announced broader and more aggressive enforcement that specifically applies to public demonstrations conducted on behalf of foreign powers.
In a statement released today, DOJ warned that citizens and noncitizens may face civil or criminal liability when they act in the United States under the direction or control of a foreign government or foreign principal without registering.
“If a person acts as an agent of any foreign power to carry out any public activity, including public demonstrations designed to further the propaganda or other goals of the foreign power, he or she must register with or notify the appropriate federal authorities.”
Failure to comply can result in up to five years in prison.
This is significant.
In February 2025, Attorney General Pam Bondi directed DOJ to reserve criminal FARA prosecutions primarily for conduct resembling traditional espionage by foreign-government actors. Ordinary violations were generally supposed to be addressed through civil enforcement and regulatory compliance.
Today’s announcement moves in a substantially more aggressive direction. It places foreign-directed demonstrations, political activism, propaganda operations, covert funding, intermediaries, and false affiliations directly within DOJ’s announced enforcement priorities.
