SAF @2AFDN - BREAKING NEWS: The Trump Administration Attorney General's Office of Legal Counsel has published a formal opinion concluding that the federal ban prohibiting licensed dealers from selling handguns to qualified adults aged 18-20 is unconstitutional under the Second Amendment.
It is a massive step forward for the federal government to now agree with the positions SAF has taken in multiple critical lawsuits, including the landmark Reese case which likewise struck down the ban.
OLC Memos are a way for the administration to formally lay out its own position as to the particular statute. Its reasonable to then assume that this administration will not prosecute licensed dealers for violations of these two subsections of the law, which it has now formally opined is unconstitutional.
However...
This is not a binding opinion on any court or on future administrations. Future administrations could reverse course, and there are mechanisms for a court to assign someone other than the administration to defend the law in currently ongoing or future cases.
